Privacy policy

This policy explains how we collect and use personal information when you visit unparalleled.co.za, enquire about our services or work with us. We handle this information under South Africa’s Protection of Personal Information Act, 2013 (POPIA).

Who we are

Unparalleled (Pty) Ltd is a South African digital marketing agency, registration number 2025/126177/07, at 387 Cremant Street, Val de Vie, Paarl, 7646, South Africa.

For information we collect for our own business purposes, we are the responsible party under POPIA. When we process a client’s customer information on that client’s instructions, we generally act as an operator, and the client’s privacy notice and our agreement with that client apply to that processing.

Information we collect

When you send an enquiry, we collect the details you provide. These may include the services you are interested in, your business stage, your first and last name, company name, email address, phone number, approximate budget, intended start date and a description of your project. We also keep relevant correspondence when you contact us by email, phone or WhatsApp.

If you become a client, we process the business contact details, proposals, agreements, project communications and billing information needed to manage our working relationship. A business contact may also give us a colleague’s details so that we can work with that person.

If you request our portfolio on our Coming Soon page, we collect your name and email address so that we can send you the portfolio and let you know when the page is live. It does not subscribe you to a newsletter.

When you browse the website, our hosting provider records technical information such as IP addresses, request dates, browser details and the pages requested, so that the website can run securely. Wordfence, our security plugin, also checks visits and login attempts for malicious activity, which involves processing IP addresses and request details. Google Analytics and Metricool collect information about how the website is used, as described in our Cookie policy.

Some pages show content from other services. Our home page displays images from our Instagram account, loaded from Meta’s servers, and an embedded YouTube video from Google. When this content loads, your browser connects directly to those services, which receive your IP address and browser details, and YouTube sets its own cookies. Meta and Google handle that information under their own privacy policies. If you message us on WhatsApp, which is also owned by Meta, the conversation is handled under WhatsApp’s terms as well as this policy.

Why we use this information

We use your information to respond to enquiries, discuss your project, prepare proposals, deliver the services we agree on, manage our accounts and working relationships, send the portfolio and updates you have asked for, protect our systems and meet our legal obligations. We use website statistics to understand which content is useful and to improve the website.

Depending on the activity, POPIA allows us to process information with your consent, to take steps towards or perform a contract, to meet a legal obligation, or to pursue a legitimate business interest while respecting your privacy. Visiting the website does not count as consent to every use of your personal information.

Fields marked as required on our forms are needed for us to respond properly. If you leave them out, we may not be able to respond or prepare a useful proposal. Other fields are optional. If you become a client, tax and company recordkeeping laws may require us to keep certain records.

Where information is stored and who receives it

Enquiries and portfolio requests sent through the forms on our website are processed by Formspree, a form service, which delivers them to our business email at info@unparalleled.co.za. We use Google Workspace for email and documents, and Hostinger to host the website. Wordfence, provided by Defiant, Inc., protects the website against attacks, and Metricool, a Spanish analytics platform, provides website visit statistics alongside Google Analytics.

Our founders, and service providers we authorise, may access information where their work requires it. These providers include hosting, email, document storage, project management and specialist delivery suppliers. We share only what is relevant to the purpose and expect our providers to keep it confidential and secure. We may also disclose information when the law requires it or to establish, exercise or defend legal rights.

We do not sell enquiry details or client contact lists.

AI tools and processing outside South Africa

We use AI-assisted tools, including Claude, for tasks such as drafting, summarising business communications and managing content. Where these tools are connected to our business systems, relevant personal information may be processed by the AI provider as part of that work.

Some of our providers, including Formspree, Google, Anthropic, Meta and Wordfence, are based in or process information in other countries, such as the United States. Metricool is based in Spain, in the European Union. When personal information is transferred outside South Africa, we rely on a basis permitted by section 72 of POPIA, such as the recipient being bound by laws or agreements that give adequate protection.

Cookies and marketing

Our Cookie policy explains the cookies and similar technologies used on the website, including Google Analytics, Metricool and the embedded YouTube video, and how you can control them. We do not use advertising or retargeting pixels on the website.

Sending an enquiry does not subscribe you to promotional emails. We may contact you about your enquiry or our agreed work. If we introduce newsletters or other promotional messages, we will only send them where POPIA allows, either with your consent or as an existing client, and every message will include a simple way to opt out.

Retention and security

We keep personal information only for as long as we need it for its purpose, unless the law, a contract or a legitimate recordkeeping need requires us to keep it longer. We then delete it, destroy it securely or remove the details that identify you. Records needed for a legal dispute may be kept until the matter is resolved.

We protect personal information with reasonable technical and organisational measures, including limiting access to the people who need it and using password-protected business accounts. If a security compromise occurs, we will make the notifications that POPIA requires.

Your rights and complaints

Subject to POPIA’s requirements and exceptions, you may ask whether we hold personal information about you, request access to it, ask us to correct or delete it, object to certain processing, and withdraw consent where we rely on consent. Withdrawing consent does not affect processing that was lawful before you withdrew it, or processing that has another lawful basis.

Contact Elze at info@unparalleled.co.za. We may ask for reasonable proof of identity before releasing or changing records, and we will explain any applicable procedure, lawful fee or reason a request cannot be granted. You may object to direct marketing at any time.

You may also complain directly to the Information Regulator (South Africa), whether or not you have contacted us first.

Sensitive information

Our website and enquiry forms are for business enquiries. Please do not send patient records, health information, identity documents, information about children or other sensitive information through the general enquiry form. If a project requires this kind of information, we will agree on the right instructions and safeguards with you first.

Changes to this policy

We may update this policy when our services, systems or legal obligations change. The current version and its publication date will always be available on this page. If we start using personal information in a significantly new way, we will give appropriate notice and, where required, ask for consent.
